When the Supreme Court has made a decision, as it has in the case of the wrongfully-deported Abrego Garcia, the response from the Executive cannot be "Nah." If there is no check on Trump, even in the case of his hand-picked court saying he's wrong, the Constitution is no longer functional.

Does anyone have any thoughts on choosing which email lists to stay on and which to unsubscribe to?

I've been spamming my senators and rep with emails--basically every time I get an email asking me to send an email to them, I've been doing so. I get great joy out of flooding their inboxes!

The downside of this frequent activity is that I've been added to more and more email lists to the point where I'm now getting at least 20 emails a day asking me to sign a petition, send an email, donate money, or just be informed. It's definitely too much, but I'm not feeling like I have a good idea of how to decide which ones are worth staying on and which I should unsubscribe to.

I also feel that this habit of sharing mailing lists between all these progressive organization is not a great strategy--my fear is that people will become so overwhelmed by the deluge of emails that they'll just start unsubscribing to all of them or deleting them immediately.

Does anyone have any thoughts on this topic? Commiseration would also be acceptable!

I've been calling my US senators and representative, and realized that I shouldn't ignore my state-level folks either. Obviously, they can't change federal anything, but I can ask them to make state policies/laws/guidelines that will help mitigate the awful of (insert whichever federal issue here).

I started by calling my state rep, and got an actual person, who seemed rather surprised to get a constituent call (?), recommending that I email the representative so she could see my concerns directly. OK, then.

Indivisible has call and email scripts loaded to ask senators to oppose the nominations of Kash Patel, RFK, Jr., Russell Vought, and Tulsi Gabbard to important executive positions.

The Affordable Connectivity Program, which subsidizes Internet access and therefore makes Internet connections possible for many people, is set to run out of funding in about a week. The end of this program will cause many low-income people to lose Internet access; in my state alone, 1 in 5 households get rebates from the ACP, and many of them would be unable to continue to afford Internet without that support.

Pharmaceutical company Vertex has developed a drug that provides effective treatment for many people with cystic fibrosis, reducing their symptoms, reducing the likelihood of other infections and in general improving their quality of life and life expectancy.

But in many countries (including a "rich" country like the UK, where it probably won't be available through the National Health Service because it really is that expensive), this drug is unaffordable. Just Medicine is urging people to write to Vertex's CEO to ask the company to lower the cost of the drug. There's more information and a template letter here that you can customise:

Quoting from the post:
As pediatric cancers are very rare, there is often very little research and funding available, leaving many families stranded for support and care. [...] There are a few things that this community is asking support for:

1. Renewal of the Gabriella Miller 2.0 Kids First Research Act - this is the year it sunsets. This act supports funding and data gathering for kids with pediatric cancers and rare diseases.
2. Co-sponsor/support the Give Kids a Chance Act, HR3433, which provides for combinations of new cancer drugs for kids with cancer. This one does not cost taxpayers any money.

Both of these have been supported by both Republicans and Democrats, but there is a lack of awareness, as it's not an easy topic to broach for many people. My House Rep Swalwell, has pledged his commitment. So if you are so inclined, please send a message to your legislators!

[personal profile] satsuma left a comment on our sticky post flagging up S.2767 - SSI Savings Penalty Elimination Act.

This legislation would change the amount an individual on SSI can save from $2,000 to $10,000, and the amount a family can save from $3,000 to $20,000. It would also adjust the limit for inflation in the future and exclude retirement savings.

This would ensure people on SSI aren't always teetering on the edge of disaster if they have just one unexpected expense, such as needing a repair to their assistive technology or needing to move home, as well as helping family members move into work or accept better jobs (or marry their long-term partners!) without risking the loss SSI benefits in the family.

NDAs play a huge role in enforcing silence around discrimination and harassment and are particularly beloved of tech and entertainment companies. Pinterest, for example, famously bound many of its BIPOC employees with NDAs that prevented them from speaking out about pervasive racist harassment at the company, and NDAs also restricted many women in the entertainment industry from speaking out on MeToo matters. NDAs act as, essentially, a loophole in federal whistleblower law, threatening people who want to speak up about poor treatment at the hands of past employers with loss of pay and possible legal action. In 2018, California passed SB 820, which specifically bans NDAs in cases of sexual harassment, sexual assault, and sex discrimination. SB 331, or the Silenced No More Act, seeks to complement this bill by banning NDAs in all cases of workplace harassment and discrimination, including along axes of race, disability, age, and religion. SB 331 has passed the State Senate and now faces the Assembly.

This is an environmental and Indigenous-rights set of actions.

Thacker Pass/Pee'hee Mu'huh is sacred and historically significant land to the northern Paiute and the Shoshone. It is unceded, but currently managed as public land by the Bureau of Land Management. It is vital habitat for many endangered flora and fauna, some endemic to only this region. Due to Trump-era environmental deregulation, it is also the proposed site of a giant lithium mine run by Canadian company Lithium Americas.

Lithium Americas says this is a "green" mine, meant to provide batteries for electric cars, but the impact would be environmentally devastating. Lithium mining means open-pit mining and the chewing up of mountaintops in the refining process, such that producing one ton of lithium will require strip mining and processing between ~110 and 500 tons of Earth. Alongside the lithium, the process produces hundreds of tons of sulfur waste, including sulfuric acid. It will also burn enormous quantities of diesel and suck up hundreds of thousands of gallons of water -- in Nevada. All this quite aside from the fact that it will require eating up more than 5,000 acres of sacred and irreplaceable land, threatening the wider watershed, cutting off its relationship to its originary stewards, and truncating a critical wildlife corridor.

How I heard about this was because Lithium Americas is 49% owner of Minera Exar, a South American company accused of misleading and violating principles of free, prior, and informed consent of Indigenous communities in the vicinity of their mine in Argentina. This is only part of the horrific abuses against Indigenous peoples living around lithium mines in the Andes, and you'd better believe the same will happen in the U.S.

All this to say, it must be stopped, and people are working to stop it.

Indigenous and environmental activists in Minnesota have been fighting the Enbridge Line 3 tar sands pipeline for years now, but recently there has been a huge surge in national pushback against the pipeline as well. Here are some ways to help the effort:

1. Contact the White House directly to ask Biden to stop Line 3. The email I sent read:
 
Dear President Biden,

I am writing to you to ask you to stop construction of the Line 3 tar sands pipeline in Minnesota. I am extraordinarily glad and grateful that one of your first acts in office was to stop the Keystone XL pipeline, and so I am asking you to once again product our climate and our future by halting the Line 3 pipeline as well.
 
Line 3 would cross more than 200 bodies of water in northern Minnesota, crossing reservation boarders and land that the Ojibwe and Dakota people hold treaty rights to and use for food production, including most especially wild rice. The likelihood of a leak or spill, and the devastation that that would cause to people and the climate, is enormous. Even if the pipeline works as it should, its climate effects will be horrific and directly counter to this administration's stated goal of tackling the climate emergency--Line 3 would create more pollution than the equivalent of 50 coal plants.
 
As a Minnesota resident I am devastated that my state leaders have abdicated their responsibilities to the environment, to the Ojibwe and Dakota people whose lands we occupy, and to our children's futures by not stopping the constriction of Line 3 before now. President Biden, please step in where they have failed, and call an immediate halt to the construction of Line 3, as well as a stop to the use of the pipeline it was slated to replace. We need you and are counting on you.

2. Tell banks to stop funding Line 3. There's an important loan renewal deadline for Enbridge on March 31st, 2021--please use this form to email executives at the banks that are funding Line 3 to tell them to not renew their loans to Enbridge. The text of the letter can be edited, so please take advantage of that to rephrase and personalize the text (while still keeping the main info). Here is my edited version of the text:

Dear bank executives,
 
I am writing to you today to demand that your company does not continue its participation in $2.16 billion credit facility renewal with Enbridge on March 31st, 2021. 
 
Enbridge is the company responsible for the building of the Line 3 tar sands pipeline, which is going on right now in defiance of treaty rights and grave environmental concerns over its construction. If built, Line 3 would cross more than 200 bodies of water in northern Minnesota, crossing reservation boarders and land that the Ojibwe and Dakota people hold treaty rights to and use for food production, including most especially wild rice. The likelihood of a leak or spill, and the devastation that that would cause to people and the climate, is enormous. Renewing your loan to Enbridge is a significant social risk to your company's reputation. A wide variety of groups, including the Red Lake Nation, the White Earth Band of Ojibwe, and Mille Lacs Band of Ojibwe, MN’s Department of Commerce, and multiple environmental organizations, are currently challenging the legality of Line 3 in court. Meanwhile, over 200,000 people have signed a petition demanding that President Biden take Executive Action to stop Line 3, and Minnesota Representative Ilhan Omar has written to President Biden demanding the same. Recently, more than 600 people took to the streets of St. Paul demanding a stop to the pipeline. The best-selling novelist and member of the Turtle Mountain Band of Chippewa Louise Erdrich wrote in the New York Times: “[Line 3] is is a tar sands climate bomb (...) The state’s environmental impact assessment of the project found the pipeline’s carbon output could be 193 million tons per year. That’s the equivalent of 50 coal-fired power plants or 38 million vehicles on our roads.”
 
The climate movement has grown dramatically in recent years, gaining more people and more power. Now that the Keystone XL pipeline has been canceled, stopping Line 3 is the number one priority for huge numbers of climate activists across the United States. Your company's funding of Line 3 will not go unnoticed. 
 
Therefore, I strongly urge your company to do the right thing for the environment, for Native rights, and for your own company's reputation, and walk away from Line 3 and the $2.16 billion credit facility renewal with Enbridge on March 31st.

I kept the general flow of the original letter, but used text from my above letter to Biden and significantly rephrased and edited much of the letter to make it my own.

3. If you have money in a bank that funds Line 3 and other pipelines, strongly consider closing your account and moving your money to a credit union or smaller bank that doesn’t fund climate change. (Click here for a zoom-in-able version of the graphic if you’re having trouble reading it.)

The list includes all the major US banks, including JP Morgan Chase, Wells Fargo, Bank of America, and Citibank, along with many international institutions, including Deutsche Bank, Credit Suisse, Royal Bank of Canada, and many more. Tips for moving your money out of these banks can be found here. (The list/graphic look to be a few years old, but I believe it to still be largely accurate. If you'd like help researching your bank, let me know.)

4. Sign a petition. There are lots of these going around, and they take less than a minute each to sign. Here are some I know of, from StopLine3.org, 350.org, the Rainforest Action Network, and the Sierra Club (this last one will require you to put in your address). 
 
5. Donate. You can donate to Honor the Earth, an Indigenous activist group that founded StopLine3.org, here. You can donate to the frontlines trying to keep the pipeline from being built through StopLine3.org here or through the RAN's microgrants program here

Now that the 2021 legislative sessions have begun in most states, state lawmakers have already introduced hundreds of bills aimed at election procedures and voter access. Some of them are good and will make it easier for people to vote; some of them are bad and will make voting harder or will disenfranchise people.

The Brennan Center has done a round-up of all the new bills so you can check out what's going on in your state and contact your state reps to encourage them to either oppose or support the bills they'll be voting on.

Early this winter and spring before COVID reached the U.S., the University of California ASE union, UAW, organized graduate student worker actions at all nine campuses to agitate for better wages and housing relief in the face of overwhelming rent burden. UC Santa Cruz was at the forefront of the COLA movement, and its students faced the harshest (illegal) retaliation.

Carlos Cruz, a first-generation grad worker, is the only graduate student across the UC still facing discipline for his participation in labor action in Spring 2020. While all other workers have won reinstatement, Carlos is still facing a two-year suspension. Suspension in the midst of a deepening pandemic is effectively firing and deprives Carlos of healthcare through the university. The preponderance of police testimony used against Carlos, meanwhile, suggests racialized targeting.

After 11 hours of hearings and testimony, the UCSC student board had decided to drop the two-year suspension meted out to Carlos Cruz--but in an unprecedented move, a campus administrator overruled this board. Associate Vice Chancellor Sue Matthews, not party to the hearing, decided that she “did not support” this finding.

The UAW 2865 grievance against the use of student conduct to discipline labor actions is still ongoing. In addition, there is another chance for ASEs and allies to take action to protect Carlos: a final appeal in the student conduct code, to UCSC Chancellor Cythia Larive. UAW is requesting that supporters write an email or a letter to Chancellor Larive demanding that she use her authority responsibly and bring a speedy resolution to this saga by dropping all charges.

It's a painfully low bar and it might seem galling to have to praise them for stepping over it when it's on the floor, but positive reinforcement is REALLY POWERFUL, especially when they'll be getting a tonne of blow-back from Trumpists.

The so-called 'Anti-Terrorism Bill' "criminalizes activism, labels any form of dissent as terrorism, and allows civilians to be unlawfully monitored and arrested without a warrant." The focus this week has again been on immigration and family separation, with rallies across the country. If you were able to attend a rally and would like to talk about your experiences in the comments, we'd love to hear about them.

The conversation widened to cover the Muslim Ban, which was upheld in the Supreme Court -- just one of several 5-4 decisions in the last few weeks that have also rolled back rights for many Americans. Which was all topped off by the news that Justice Kennedy is resigning, giving the Orange Menace another Supreme Court pick. SCOTUSblog has a round up of coverage of the main events involving the court in the last week, if you want to dig a little deeper into the cases and the implication's of Kennedy's decision.

What's next? It's been quiet in the comm, but we still have lots of ongoing actions relating to these issues and to the vital mid-term elections.
